David Amos has been dealing with the sidestepping bureaucracy for over
the past decade, during which time he has been carefully detailing the
paper trail of correspondence between offices that are supposed to be
keeping public administration and oversight of the investment system
on the up and up. He has been disappointed and marginalized by
agencies that are willing to depersonalize Dave for bringing difficult
and or complex information to their attention, + it appears that some
of these official channels are dealing with conflict of interest that
has prevented their discharging their duties.

I have seen this kind of saga before. It is really unfortunate that
there is no centralized system for vetting facts so that casework on
getting honest and effective governance could me more automatic,
rather than a constant merrygoround of dysfunction. I have replied to
Dave that one thing that I would like to see as a campaign within
Council of Canadians is an honesty in public administration
investigative squad that could undertake to verify facts - rather than
sit back and see citizens undergo atrocities when they are trying to
get the factual record acknowledged.

Perhaps if the Community Chapters project of Unifor can get rolling
nationally, this could be a way for a United Advocacy Network to have
a major pillar of backing. It is necessary that when we are witnessing
criminal activities being systematically ignored, we must understand
that this is intolerable, and all citizens at all levels need to
comprehend that this kind of performance must be replaced in the
interest of restoring a trustworthy political economy.

Thanks very much for the message Wes - am rejoicing at the fact the
motion was passed. I will share this with our facebook page, and I am
going to mention this to the London Ont chapter - who put forward a
motion to reaffirm the role of the Bank of Canada at the 2011 AGM
which also passed. This indicates a will to further the presence of
public banking in Canada. It may be possible to get Steve, the
Director of Collaboration for VanCity to find a way for VanCity to
mentor the creation of public banks at the municipal level. When I met
him earlier this month at the Social Economy World Forum in Calgary,
he had not been briefed on the dangers to depositors from the Bank for
International Settlements 'bail in scheme" resulting from the Cyprus
crisis.

Due to health, I am not able to get to the AGM this year, but I have
some comments that I would like to make about the Proposed Resolution
#8 and #9 that are on the agenda for consideration at tomorrow's
meeting:

1) The need for Canada to have an organized response to the idea that
tax-payer supported bailouts of banks - as in the 2008 crisis - can be
avoided by having the depositors forfeit their deposits to pay for
derivative-caused losses resulting in bank insolvency; this is a moral
and ethical challenge, that must be faced squarely by every Canadian.
I urge every member of Council of Canadians to watch the video that is
referenced in the Proposed Motion #8. The link for the video "Money is

The subject of international banking agreements is the contextual
basis for trade and commercial agreements, and therefore this subject
is within the terms of reference of the Trade campaign section of the
Council of Canadians. Please find attached an excerpt from the
"Economic Action Plan 2013" that confirms that Canada is supporting
the bail-in concept described in the video listed above.

Thanks very much to the London Chapter for noting the seriousness of
this matter. In my view, there could be no more blatant example of the
will to consolidate all wealth at the top, than the idea of
confiscating the deposits of the the population in their chartered
banks - in order to pay for the bad luck of investment-house gamblers.

The Public Banking Institute is very co-operative with the forming of
a Canada Chapter, and we can develop a program of action to get public
banking developed as a usable option for municipalities. This would be
the ultimate way to prevent disempowerment of local communities, by
the wealth concentration that is the trend accompanying the activities
of transnational corporate concentration. To view that activities of

2) Constitutional Development: There is some concern that this subject
does not fit within the existing campaigns of the Council of
Canadians, but I would suggest that the active involvement of the
people of Canada in proposing a formula for getting our constitutional
process re-energized is a topic that is of existential value to the
whole country. It deals with what we value in our cultural history
that can affirm the values that come from that history. If the settler
community makes a standing invitation to the indigenous people of
Canada to consider the role of hosting a process by which we are able
to bring together all the cultural foundations that will give us a
coherent basis for our rights and freedoms, that is based on our
ancestral values and sense of community - we will be able to achieve a
deeper, authentic national identity.

Thanks for your supporting the above goals, and while they are helpful
in the enabling of further action - they do not commit the Council to
anything obligatory. They are useful in a developmental view of our
potential as a society - that is autonomous, democratic and
post-colonial.

100 Years Is Enough: Time to Make the Fed a Public Utility

December 23rd, 2013, marks the 100th anniversary of the Federal
Reserve, warranting a review of its performance. Has it achieved the
purposes for which it was designed?

The answer depends on whose purposes we are talking about. For the
banks, the Fed has served quite well. For the laboring masses whose
populist movement prompted it, not much has changed in a century.

Thwarting Populist Demands

The Federal Reserve Act was passed in 1913 in response to a wave of
bank crises, which had hit on average every six years over a period of
80 years. The resulting economic depressions triggered a populist
movement for monetary reform in the 1890s. Mary Ellen Lease, an early
populist leader, said in a fiery speech that could have been written
today:

Wall Street owns the country. It is no longer a government of the
people, by the people, and for the people, but a government of Wall
Street, by Wall Street, and for Wall Street. The great common people
of this country are slaves, and monopoly is the master. . . . Money
rules . . . .Our laws are the output of a system which clothes rascals
in robes and honesty in rags. The parties lie to us and the political
speakers mislead us. . . .

We want money, land and transportation. We want the abolition of the
National Banks, and we want the power to make loans direct from the
government. We want the foreclosure system wiped out.

That was what they wanted, but the Federal Reserve Act that they got
was not what the populists had fought for, or what their leader
William Jennings Bryan thought he was approving when he voted for it
in 1913. In the stirring speech that won him the Democratic
presidential nomination in 1896, Bryan insisted:

[We] believe that the right to coin money and issue money is a
function of government. . . . Those who are opposed to this
proposition tell us that the issue of paper money is a function of the
bank and that the government ought to go out of the banking business.
I stand with Jefferson . . . and tell them, as he did, that the issue
of money is a function of the government and that the banks should go
out of the governing business.

He concluded with this famous outcry against the restrictive gold standard:

You shall not press down upon the brow of labor this crown of thorns,
you shall not crucify mankind upon a cross of gold.

What Bryan and the populists sought was a national currency issued
debt-free and interest-free by the government, on the model of
Lincoln's Greenbacks. What the American people got was a money supply
created by private banks as credit (or debt) lent to the government
and the people at interest. Although the national money supply would
be printed by the U.S. Bureau of Engraving and Printing, it would be
issued by the "bankers' bank," the Federal Reserve. The Fed is
composed of twelve branches, all of which are 100 percent owned by the
banks in their districts. Until 1935, these branches could each
independently issue paper dollars for the cost of printing them, and
could lend them at interest.

1929: The Fed Triggers the Worst Bank Run in History

The new system was supposed to prevent bank runs, but it clearly
failed in that endeavor. In 1929, the United States experienced the
worst bank run in its history.

The New York Fed had been pouring newly-created money into New York
banks, which then lent it to stock speculators. When the New York Fed
heard that the Federal Reserve Board of Governors had held an
all-night meeting discussing this risky situation, the flood of
speculative funding was retracted, precipitating the 1929 stock market
crash.

At that time, paper dollars were freely redeemable in gold; but banks
were required to keep sufficient gold to cover only 40 percent of
their deposits. When panicked bank customers rushed to cash in their
dollars, gold reserves shrank. Loans then had to be recalled to
maintain the 40 percent requirement, collapsing the money supply.

The result was widespread unemployment and loss of homes and savings,
similar to that seen today. In a scathing indictment before Congress
in 1934, Representative Louis McFadden blamed the Federal Reserve. He
said:

Mr. Chairman, we have in this Country one of the most corrupt
institutions the world has ever known. I refer to the Federal Reserve
Board and the Federal Reserve Banks . . . .

The depredations and iniquities of the Fed has cost enough money to
pay the National debt several times over. . . .

Some people think that the Federal Reserve Banks are United States
Government institutions. They are private monopolies which prey upon
the people of these United States for the benefit of themselves and
their foreign customers; foreign and domestic speculators and
swindlers; and rich and predatory money lenders.

These twelve private credit monopolies were deceitfully and disloyally
foisted upon this Country by the bankers who came here from Europe and
repaid us our hospitality by undermining our American institutions.

Freed from the Bankers' "Cross of Gold"

To stop the collapse of the money supply, in 1933 Roosevelt took the
dollar off the gold standard within the United States. The gold
standard had prevailed since the founding of the country, and the move
was highly controversial. Critics viewed it as a crime. But proponents
saw it as finally allowing the country to be economically sovereign.

This more benign view was taken by Beardsley Ruml, Chairman of the
Federal Reserve Bank of New York, in a presentation before the
American Bar Association in 1945. He said the government was now at
liberty to spend as needed to meet its budget, drawing on credit
issued by its own central bank. It could do this until price inflation
indicated a weakened purchasing power of the currency. Then, and only
then, would the government need to levy taxes—not to fund the budget
but to counteract inflation by contracting the money supply. The
principal purpose of taxes, said Ruml, was "the maintenance of a
dollar which has stable purchasing power over the years. Sometimes
this purpose is stated as 'the avoidance of inflation.'"

It was a remarkable realization. The government could be funded
without taxes, by drawing on credit from its own central bank. Since
there was no longer a need for gold to cover the loan, the central
bank would not have to borrow. It could just create the money on its
books. Only when prices rose across the board, signaling an excess of
money in the money supply, would the government need to tax—not to
fund the government but simply to keep supply (goods and services) in
balance with demand (money).

Ruml's vision is echoed today in the school of economic thought called
Modern Monetary Theory (MMT). But after Roosevelt's demise, it was not
pursued. The U.S. government continued to fund itself with taxes; and
when it failed to recover enough to pay its bills, it continued to
borrow, putting itself in debt.

The Fed Agrees to Return the Interest

For its first half century, the Federal Reserve continued to pocket
the interest on the money it issued and lent to the government. But in
the 1960s, Wright Patman, Chairman of the House Banking and Currency
Committee, pushed to have the Fed nationalized. To avoid that result,
the Fed quietly agreed to rebate its profits to the U.S. Treasury.

In The Strange Case of Richard Milhous Nixon, published in 1973,
Congressman Jerry Voorhis wrote of this concession:

It was done, quite obviously, as acknowledgment that the Federal
Reserve Banks were acting on the one hand as a national bank of issue,
creating the nation's money, but on the other hand charging the nation
interest on its own credit—which no true national bank of issue could
conceivably, or with any show of justice, dare to do.

Rebating the interest to the Treasury was clearly a step in the right
direction. But the central bank funded very little of the federal
debt. Commercial banks held a large chunk of it; and as Voorhis
observed, "[w]here the commercial banks are concerned, there is no
such repayment of the people's money." Commercial banks did not rebate
the interest they collected to the government, said Voorhis, although
they also "'buy' the bonds with newly created demand deposit entries
on their books—nothing more."

Today the proportion of the federal debt held by the Federal Reserve
has shot up, due to repeated rounds of "quantitative easing." But the
majority of the debt is still funded privately at interest, and most
of the dollars funding it originated as "bank credit" created on the
books of private banks.

Time for a New Populist Movement?

The Treasury's website reports the amount of interest paid on the
national debt each year, going back 26 years. At the end of 2013, the
total for the previous 26 years came to about $9 trillion on a federal
debt of $17.25 trillion. If the government had been borrowing from its
own central bank interest-free during that period, the debt would have
been reduced by more than half. And that was just the interest for 26
years. The federal debt has been accumulating ever since 1835, when
Andrew Jackson paid it off and vetoed the Second U.S. Bank's renewal;
and all that time it has been accruing interest. If the government had
been borrowing from its central bank all along, it might have had no
federal debt at all today.

In 1977, Congress gave the Fed a dual mandate, not only to maintain
the stability of the currency but to promote full employment. The Fed
got the mandate but not the tools, as discussed in my earlier article
here.

It may be time for a new populist movement, one that demands that the
power to issue money be returned to the government and the people it
represents; and that the Federal Reserve be made a public utility,
owned by the people and serving them. The firehose of cheap credit
lavished on Wall Street needs to be re-directed to Main Street.

California Dreaming: Why I Am Running for State Treasurer in 2014


Two years ago, in the fall of 2011, a bill for a feasibility study for
a California state-owned bank passed both houses of the California
legislature. The Public Banking Institute, which I founded and
chaired, was instrumental in helping to get the bill as far as it got.
But it died when Governor Jerry Brown vetoed it. His reasoning was
that we already had a banking committee, and that the matter could be
explored in-house. However, we have heard no more about it since.

I am therefore running for California State Treasurer on a state bank
platform, along with Laura Wells, who is running for Controller. Our
vision is to transform California, the world's eighth largest economy,
into a financially sovereign state. We are running on the ticket of
the Green Party, because it takes no corporate money. Candidates who
take corporate money – and that means nearly all conventional
candidates – are beholden to large corporate interests and cannot
adequately represent the interests of the disenfranchised 99%.

I got my undergraduate degree at UC Berkeley in the 1960s, when
tuition was free; and my law degree at UCLA in the 1970s, when tuition
was $600 a year. Today it is $12,000 and $35,000, respectively, for
in-state students. In the 1960s, the governor of California was Jerry
Brown's father Pat Brown, a New Deal visionary who believed that
investment in education, infrastructure and local business was an
investment in the future. His son evidently has lost that vision; or
perhaps he just lacks the vision to see how it can be done in today's
debt-ridden climate. We believe that it can be done, and we are
throwing our bonnets in the ring for the opportunity to convince the
governor of that fact.

Our primary evidentiary model is North Dakota, the only state to
escape the 2008 credit crisis — and the only state to own its own
bank. North Dakota has the lowest unemployment rate in the country,
the lowest foreclosure rate, the lowest default rate on credit card
debt, and no state debt at all.

By law, all of the state's revenues are deposited in the Bank of North
Dakota (BND), which is set up as a DBA of the state. The bank then
uses its capital and deposits to generate credit for local state
purposes. The BND partners with local banks rather than competing with
them, strengthening their capital and deposit bases and allowing them
to keep loans on their books rather than having to sell them off to
investors. This practice allowed North Dakota to avoid the subprime
crisis that destroyed the housing market in other states.

I have been studying the BND model since the fall of 2008, when it
first showed its mettle in the banking crisis; and have written over
200 articles on that and related subjects, which can be found on my

that if we had the opportunity to work with the governor and the
treasurer's department, we could show them how a state-owned bank can

Hundreds Gather for Public Banking and Economic Justice

By any standards, the 2013 Public Banking Conference, held at
beautiful Dominican University in San Rafael, California, was a
success. In a political world where like-minded groups seldom converge
on practical policy blueprints, it was an astounding success. Hundreds
of committed attendees–Occupy activists, religious groups, labor,
environmentalists, legal activists, journalists and progressive
economists–came together for three days of heady conversations and
inspiring presentations, and by all accounts, everyone left with
something resembling a vision.

Understanding the socioeconomic context under which the Conference
took place is useful in seeing why so many leading activists and
scholars felt the imperative to attend. While corporate profits soar,
municipalities are dying. Governments bail out big banks and leave
ordinary people out in the cold. An artificial scarcity permeates the
public sector, a product of ideology and grab-and-go capitalism, and
the deliberate starving of public services. The city of Philadelphia
recently closed 23 public schools–not just failing schools, but
successful ones. And, they opened their coffers for a $400 million
prison. Budget cuts are making it harder for abused women to leave
their abusers. The corporate media, in the words of Buzzflash-Truthout
editor Mark Karlin, renders the poor, and really anyone outside of the
corporate elite,
voiceless, faceless. The reality is that you are not news; your
existence is hardly worthy of note, with the obligatory exception of
an occasional "gee it's tough to live like this" profile of a "welfare
mom" or person unemployed and looking for work for three or four
years.

As far as economics is concerned, it appears that the only persons
entitled to speak about financial policy options are those of the
privileged class, and particularly those who have been enriched by the
current system (including politicians). Add to that at the ever
present class of "journalistic punditry," who if they are on national
television (or major market local television stations) de facto belong
to the entrenched wealthy.

Public Banking Institute Executive Director Marc Armstrong believes
the stakes are higher than they have ever been. "'Public finance' has
been wholly and completely taken over by private banks in each of our
respective governing agencies," he says. "This takeover has been so
complete that no government or quasi-government institution has
remained untouched by the investment banks, which use their blood
funnel to vacuum up the cumulative interest that drains economies of
necessary money supply."

A consensus is emerging that "the era of Big Finance capitalism" must
end–not as an ideological matter, but a practical one, as PBI
Conference speakers Margaret Flowers and Kevin Zeese wrote in an essay
published yesterday. The question, of course, is what practical steps
citizens and collective bodies might take to ensure that the
transition is smooth, democratic, and constructive. It is in this
larger background that the Conference took place–a time when good
people are desperately seeking solutions that are not only practical,
but palatable—and not only to ordinary working people, but to the
handful of genuinely conscientious people who've managed to gain
positions of political and cultural leadership in a quite imperfect
world.

"What impressed me about the conference was the very rapid growth of
the public banking movement," says Tim Canova, Professor of Law and
Public Finance at NOVA Southeastern University and a strong voice for
public banking. "I met activists from all corners of the country
working at the local level to start public banks in their own
communities. This also reflects a growing consciousness of the
political importance of credit and the historical role of public
banking in efforts to achieve sustainable economic development."

Public banking is not a new idea. Interest in the creation of
state-run banks was spreading nationwide three years ago when John
Nichols described the phenomena in the pages of The Nation. And, of
course, the Bank of North Dakota has long been a model of sustainable
economics in the midst of the chaos created by private capital. "In
North Dakota, public debt is financed by its own public bank, allowing
for interest to be paid back, in the form of lower taxes or increased
public services, to the very people who pay the interest," says Marc
Armstrong. "North Dakotans have thrown off these supposed masters of
finance, replacing them with public servants, working for the Bank of
North Dakota, to further the interests of their people."

In its simplest manifestation, a public bank is a democratically-run,
fiscally transparent bank designed to serve community stakeholders
rather than capital shareholders. The profits of public banks are
returned to the public, whereas privately owned banks increase
taxpayer costs through compound interest and are compelled to return
profits to shareholders. Public banks issue credit at low-cost or
no-cost to cities and states. Public banks can offer "bridges" to
residential, agricultural, and public works financing, as the BND did
during the Great Depression. BND also partners with the private
sector, encouraging entrepreneurial startups and providing
check-clearing, liquidity, and bond account safekeeping to private
banks. PBI President Ellen Brown adds:

A new publicly owned bank would have a clean set of books, untainted
by the Wall Street addiction to gambling in complex derivatives; and
its profits would go back to the local government and community,
rather than being siphoned off in exorbitant salaries, bonuses, and
dividends. A publicly-owned bank could funnel credit where it is
needed most, directly into the local economy.

Although this blueprint for public banks was the guiding vision of the
Conference, several complimentary economic themes emerged from the
vast array of speakers there. Rabbi Michael Lerner explained the Debt
Jubilee movement. Margaret Flowers, Kevin Zeese, David Brodwin,
Georgia Kelly, and Arthur Stamoulis held an important forum on the
very disturbing Trans-Pacific Partnership, a threat not only to ideas
like public banking, but to huge other sectors of public goods. OpEd
News founder Rob Kall gave a rousing presentation on the general
concept of bottom-up economics, while speakers like Gar Alperovitz and
David Cobb shared their visions linking ideas like public banking to
the larger vision of a participatory, sharing-oriented economy. Space
and time do not permit a comprehensive review of the Conference, but
Leilani Clark's very accessible treatment of the Conference at
Bohemian.com is worth reading. And interested wonks may read the
entire Conference program here.

Rolling Stone economic crusader Matt Taibbi was perhaps the highest
profile guest at the Conference. He joined Icelandic parliamentarian
Birgitta Jonsdottir, PBI President Ellen Brown, and Alperovitz in a
thoughtful discussion on the relationship between the corruption of
the private financial sector and the promise of public solutions. He
also made himself available for interviews before and after that
discussion. Last month, I had expressed some hope that, after
attending the conference, Taibbi would move from criticizing big banks
to endorsing public banking. During our walk to a reception on the day
of Taibbi's attendance, a few friendly conference attendees quietly
explained to him the mechanics of the idea (although I'm sure he
already knew a great deal about it). Discussions continued through the
reception and after the public discussion that evening, and he seemed
excited to be among so many like-minded folks, and genuinely reluctant
to leave. His post-conference tweet demonstrated that he was sold on
the idea. "Want to thank all the folks from the Public Banking
institute for the event last night," he tweeted. "- amazing time – an
idea whose time has come."

In between speakers, the PBI media team interviewed both attendees and
movement leaders. The interviews and speeches were webcast by the
Community Media Center of Marin team, and according to that
organization's director, hundreds watched the webcasts from their home
computers.

Soft-spoken but surgically analytic, PBI President Brown was the
intellectual center of the Conference. Brown's work has been
instrumental in building awareness of the economic and legal facets of
public banking. This interview with Brown is informative, as were her
presentations at the Conference. Brown continues her prolific work in
an article published last week at Counterpunch, where she takes on the
student loan crisis from a decidedly egalitarian (and practical)
perspective:

Other countries make loans available to their students interest-free.
For more than twenty years, the Australian government has successfully
funded students by giving out what are in effect interest-free loans.
They are "contingent loans," which are repaid only if and when the
borrower's income reaches a certain level. New Zealand also offers 0
percent interest loans to New Zealand students, with repayment to be
made from their incomes after they graduate.

Brown's website is also up now for book orders for her new book, which
premiered at the Conference, The Public Bank Solution.

Although participants left the Conference with a lot of inspiration
and satisfaction, there was also wide recognition that more building
remains to be done. "I believe we need to engage a larger diversity of
people and especially younger people in discussions about how public
banking would address the challenges in their own lives and their own
communities," Canova told me. "We also need to recognize that we are
part of a much larger democracy movement that goes well beyond
banking. The financial crisis and sick economy have revealed the rot
in our politics, law, and institutions. It has revealed that we have
a broken democracy. The public banking movement must be at the
vanguard of the movement to restore our democracy."


Of course, there will be more PBI events in the future, and public
banking is on the agenda at other conferences, such as GreenFest 2013,
to be held Sept. 7-8 in Middlebury, Connecticut. Meanwhile, the real
test will be whether interest in public banks continues to spread
around the country, and whether activists can translate vision into
genuine policy. New York Assemblywoman Sandy Galef recently proposed a
state bank for New York, while other proposals continue to emerge, and
strong voices continue to push for the idea to explode in the public
fora.

man band, from editorial oversight, website development, and unaccounted
financial expenditures and disbursements. We also explain how only Assange

suggestion that we should appoint a firm of trusted accountants to audit our
expenditures and provide some transparency as to how our organisation spends
donor funds. Many respected NGO's operating in politically challenging

funding, or placing their staff in danger.

We estimate (no visible accounting) that Assange misappropriated
approximately $225,000 form April 2008 to April 2009 and that from 1 May
2010 to date approximately $52,000. These are disbursements with no receipts

Lack of a credible a due diligence review led to WIKILEAKS been passed over
for the KNIGHT FOUNDATION AWARD of $537,000, even though WIKILEAKS had the
majority of support from advisors to the award committee.

seriously damage Iceland's credibility concerning providing an international
data haven. We would suggest that Iceland continues to support such a bold
and courageous initiative, however, to be cautious and very aware of
WIKLEAKS potential exposure to financial mismanagement issues.
